Who We Are:

Trying complex cases, managing investigations, responding to subpoenas and search warrants, and dealing with the government require substance, experience and presence. Post & Schell’s White Collar Defense, Compliance and Risk Management Group brings unparalleled expertise, experience and knowledge of law enforcement to advising and defending our clients.

  • It is headed by Ron Levine, the former Chief of the Criminal Division of the U.S. Attorney’s Office for the Eastern District of Pennsylvania.  Ron is joined by:
  • John Joseph, the former Deputy Chief of the Civil Division, in charge of all the affirmative fraud and environmental enforcement litigation within the Eastern District;
  • Barb Zemlock, former Chief Deputy Public Defender, who represents businesses and individuals accused of misconduct at the federal and state levels; and
  • Peter Hardy, a former Assistant United States Attorney with broad experience in complex white collar investigations, domestic and international.
  • Their unique skill sets are complemented by partners with substantial in-house and plaintiff-side experience who combine to provide comprehensive representation and counseling at all phases of investigation and litigation.
  • Our White Collar Group has extensive experience with federal and state enforcement agencies, including the Department of Justice, FBI, IRS, SEC, EPA, Postal Inspection Service, and Offices of Inspector General for the Departments of Health & Human Services, Defense, Transportation and Labor.

The depth and range of the Group’s experience in criminal, civil and administrative matters provides corporate clients and senior executives with the insight into high-level enforcement decision-making essential to pursuing an informed defense strategy. Our decades of trial experience enable us to provide clients with seasoned risk assessment and sure-handed representation in the courtroom.

What We Do:

We defend corporate enterprises and individuals such as officers, directors, managers and employees, nationwide. The Group represents these clients in criminal, civil and administrative matters, at the federal, state and local levels. We conduct our clients’ internal investigations, structure their defenses, and interact with the enforcement community. Specifically, we:

  • Defend enterprises, corporations and persons who are subjects, targets or witnesses in government investigations, including False Claims Act and qui tam investigations, and related civil or administrative litigation.
  • Track and respond rapidly to all stages of an investigation (ranging from subpoena compliance and grand jury practice to the execution of search warrants or the unsealing of criminal indictments and civil fraud complaints).
  • Conduct internal investigations to assess compliance issues and to determine whether questionable conduct has occurred. Provide a complete factual, legal and risk analysis.
  • Avoid or lessen enforcement action by working with clients to fashion, implement and monitor compliance programs which conform to agency protocols and the federal Organizational Sentencing Guidelines.
  • Evaluate the need for and, where appropriate, Negotiate voluntary disclosure to relevant government agencies.
  • Negotiate corporate integrity agreements, and Monitor corporate compliance moving forward.
  • Defend collateral civil proceedings such as suspensions, debarments or exclusions or civil lawsuits in which fraud is alleged.
  • Defend enterprises, corporations, officers and directors at criminal or civil trial and/or on appeal.
