Our Construction, Government Contracts, and Surety Law Group represents a wide range of public and private entities, including owners, contractors, subcontractors, construction managers, architects, engineers, construction trade associations, sureties, and suppliers involved in the construction of projects throughout the country. Co-chaired by Kenneth Sable and Gary Wilson, this Group has years of actual experience in the construction and engineering industry in both the public and private sectors. Our attorneys are uniquely qualified to provide clients with practical answers to the technical and legal questions that arise during the course of representation. The Group’s members are active in the Forum Committee on the Construction Industry, its Public Contracts Section, and the Transportation Research Board, among other professional organizations.
Our Construction, Government Contracts, and Surety Law Group provides advice from the initial stages of preconstruction to completion of the construction project. During the preconstruction stages of a project, we anticipate the risks that will arise and determine the appropriate means of resolving these risks through the contracting process. Our proactive approach enables all parties to deal with financial and technical contingencies prior to construction which will frequently result in major cost savings on the project. The services that we provide in the preconstruction stages of the project include in part:
- Drafting, reviewing and negotiating construction contracts; and
- Counseling clients on matters of claims avoidance, project delivery methods, risk management and scheduling issues.
During construction, issues of contract administration arise that have legal and financial implications. Handling these issues on a prompt basis as they arise produces a more cost- effective and amicable result, than waiting until the end of the project when the parties’ positions have hardened and they are more geared towards litigation or arbitration. Our attorneys’ hands-on experience enables our Group to expeditiously assist clients in these contract administration issues. These issues may include (a) assisting our clients in properly documenting problems or positions, (b) providing advice on contract interpretation, and (c) negotiating change orders and contract adjustments.
When disputes cannot be prevented or resolved through planning or negotiation, the Group is prepared for aggressive prosecution or vigorous defense of our clients’ legal rights. Our Group represents clients in many state and federal courts and state boards of contract appeals, as well as administrative agencies. We are also experienced in arbitration, and in alternative dispute resolution procedures, such as mediation and mini-trials.
In representing a party in a construction suit, we continue to adhere to the principles of providing a client with cost-effective and practical advice using budgets and litigation risk analysis to guide our strategic assessment of the case.
Our Group works closely with our Construction Liability lawyers in the Casualty Department who have extensive experience in handling complex construction defect cases. We are also able to provide additional assistance through our Environmental Regulation and Litigation Group if environmental problems arise. The Environmental group has considerable experience with environmental issues arising during construction, including wetlands and storm water requirements, erosion control, waste disposal, site assessment and remediation and “clean fill” issues on contaminated sites, response to current spills and asbestos requirements related to demolition.
